Daniel Pantaleo (c. 1985- ) was the New York police officer who killed Eric Garner in 2014 with a banned chokehold. Garner’s dying words: “I can’t breathe” – 11 times. Pantaleo is White, Garner was Black. Five years later, on August 19th 2019, the New York Police Department (NYPD) fired him for using the chokehold.
Police Commissioner James P. O’Neill called the decision “extremely difficult”.
Mayor Bill de Blasio:
“Today we have finally seen justice done. … We can react with bitterness and division and be trapped by the sins of our past, or we can transform the suffering into progress, we can find redemption.”
Justice? Really?
Phantom Caucasian Justice: Pantaleo should be in prison. But neither a New York state grand jury nor the US Department of Justice (DOJ) would so much as charge Pantaleo with a crime, not even with a civil rights violation. He never had to stand trial. In the US, police officers, like billionaires, are holy beings.
Ramsey Orta, meanwhile, is in prison. He took the citizen video of the killing that went viral on the Internet.
Eric Garner was unarmed and was not threatening anyone. Pantaleo was trying to arrest Garner for selling loosies – untaxed cigarettes. But Garner was not even doing that! Because it was never about the loosies or anything like that. Not in a country where the police regularly take White male shooters alive. The Klan in blue. (Yeah, I’m bitter.)
Timeline:
- 2014: Pantaleo kills Garner, placed on desk duty. State grand jury does not indict.
- 2015: The city pays $5.9 million to Garner’s family in wrongful death lawsuit.
- 2016:
- 2017:
- 2018:
- 2019: DOJ does not indict, NYPD fires him.
The DOJ investigation held up Pantaleo’s firing. It took five years. It should not even have taken one year. As the New York Civil Liberties Union (NYCLU) noted, it was “not a tough call under the federal statute.”
The DOJ’s investigation went on for so long that it was not President Obama’s attorney general who made the decision, but President Trump’s: William Barr.
The DOJ could not be sure if Pantaleo meant to kill Garner. Ramsey Orta, unfortunately, was unable to record what was in Pantaleo’s heart. Or its saintly glow.
Pantaleo himself would not even admit he put Garner in a chokehold – despite the video and despite the medical examiner’s report which noted the cause of death as:
“compression of neck (chokehold), compression of chest and prone positioning during physical restraint by police”
It must have been a miracle.
Chokeholds were banned by the NYPD in 1993. The city gets about three chokehold complaints a week – and does nothing. Well, all right, if it makes Viral Videos they might fire the officer after five years of protests. But even that will be a bridge too far for the police union.
Licence to kill: From 1999 to 2015 NYPD officers killed 188 people. In only four cases were they charged with a crime, in only two cases were they found guilty. And in no case were they sent to prison. Like with Peter Liang, they get probation at worst.

I have always said, black people who actually think that white police or American citizens, getting merely fired from a job, because of their harassment or killing of black people is justice, are brainwashed.
white people love to give the illusion, that justice comes in the form of white people, losing a position at a company.
What really happens:
A white person performs an act of racist behavior towards a black person.
Only when and if, there is overwhelming evidence to prove such egregious actions, and after months or years of ‘investigating themselves”, they make a decision that is the most lenient as possible.
The white police officer is then fired from a job, just for them to be hired weeks later at another police dept. And in the case of a white citizen, hired at another company, regardless of the company or police dept., knowing why the white person was fired.
Yet, all the while, black people are denied jobs, because of the way we left a former employer. ie “You didn’t stay at your former employer for more than a year or you were fired from your last position.
These only apply to black people, not to white people.
White people are employable, no matter what they’ve done in their past positions at companies they’ve worked at, because they will always have another white person that will give them a job. Not only because they’re white but out of spite for the person they got fired over and to show they stand by the person’s actions.
So in summary, no black person should ever think of a white person, being fired from a company as a form of justice, after being racially abused.
White people losing their jobs, is a mere inconvenience for them…..for about a week or two.

While $5M is certainly more than the $1k a Black body was worth to a slave trader, it is not justice. It did not come out of the pocket of the perpetrator. The murderer was fired as the only means of punishment for killing another man with his bare hands. Perhaps you’d trade one of your children for $5M. I would not. Compensation is not justice.

They get a sense of belonging from joining the police gang, a sense of worth from “serving the community” and they thrive on the perceived respect and authority that the uniform commands. The problem with this conversation is a failure to know or show all of the facts! The video began after some previous activity had occurred.
No one wonder why there were 5 police at the scene. No one knows about the history of this person.
What is known is the man was killed by his asthma illness which was a result of the illegal arm around his neck.
For some reason the federal government and state government could not find legal reason to try the police. Even though there appears to be some errors in reporting the fact.
Now a failure of blacks to depend on the police in a nation where the black on black crime plus deaths is so high becomes a tragedy.
A study of blacks shows a large population living together and many states with very few blacks! Even in States like New York the black lives in the cities and the urban areas do not have massive black populations.
When people sound off with little thought about the impact of their words and do not realize the misdirection they send to reader real problems can occur.
Black people make up a minority of the population of this nation. There is no “taking anything back”. There is only moving forward in a world of enemies and friends (FOB’s – Friends of blacks).
In each southern state where blacks make up the largest number of blacks they only make up one third of the state.
Study the history of this nation and see the worse that it has been, then you might realize where we are today shows progress! The NYT story Jamestown 1619 might help see where we came from to get to where we are!

The previous activity that had occurred, and the reason 5 cops were on the scene, is that a fight was about to jump off between two black men. Eric Garner actually stepped in and defused the situation. By the time the cops arrived, everything was over and done. Their accosting Garner was a result of their being there with nothing left to do.
The tragic irony is that when they attacked and attempted to arrest Garner, he was probably basking in the afterglow of having been a successful peacemaker. His reward was being murdered.
Oh, and by the way, he was NOT selling loosies at the time.

My understanding is the facts submitted by the coroner could not prove that the choke hold was the total cause of death, that the police did not know that asthma was involved and therefore murder was not a possible cause of death.

The truth of this matter is the victim had a record of violating the law, which you chose to ignore. He had been warned to not go to that site and do what he was doing by the law. That is why there were five cops there.

You seem to agree that the choke hold was stupid but, you stop short of understanding that without that choke hold, there would have been no death. You place blind faith in the justice system’s interpretation of events and outcome and yet the system routinely fails and has been proven biased.

That’s exactly right! Eric Garner was murdered by police instead of being apprehended and processed through the same system you put so much faith in. His GoFundMe sits at $132,000 right now! He can take at least a year to find his bearings, and relocate to a new city for a new job. They all get hired to new departments. Those stories are out there, just harder to find, but they all move on with their lives while their victims remain dead.

The NYPD banned chokeholds because they get people killed – just like in this case. They knew that but did it anyway. Why? Was Garner hurting or threatening anyone? Did he just kill 22 people at Walmart? No. Nothing like that. His life was endangered and lost – for what? So that the New York tax authorities do not lose tax revenue on cigarettes? What are they, despotic, vengeful gods?
Garner’s criminal record does not matter in this case. It is not like he was a terrorist or a serial killer or something. The police are not judge, jury and executioner. They are suppose to keep people safe, not kill them for no damn good reason. They are suppose to uphold the law, not be a law unto themselves.
The reason so many Black people get upset about cases like this is because they know the police get away with murder all the time. So when something like this makes the news, complete with video, they jump on it. Eric Garner is the tip of an iceberg.

Plus cops mindsets are about ego and authority, and when Eric Garner didn’t comply that set them off. The big black brute stereotype came into play in this tragedy. Those cops judged Garner by his obesity, his dark skin, and his poverty. They felt they had the right to murder him like an animal. All of those involved in Garner’s death that day needed to be held accountable for his demise.

Now, the purpose of our black leaders today is to provide a path forward out of the life that I lived when I started out. Lynching were common! No jobs of value in the northern states, no blacks in many states, southern blacks dominated to a level of less then animals.
I experience 3 years in an all black military unit and am well aware of mistreatment that no young person can believe possible. I did not suffer the problems of the worker bees, I was in the belly of the beast where I could witness the results of white domination! (house ni–er to those of you with such big thought about how you are going to proceed).
Yet, instead we have leaders talking about the 14 killings this year, ignoring the other disasters that are occurring! If you want to talk about a mistreatment at least stick to one that justifies your complaint. Who cares about the media which sets up blacks to argue over the wrong issues and proves their failure to understand issues.
How many comments have you about a president that believe he is the chosen one? That is writing laws that are blocking progress, that has hardly any blacks in positions of authority, that refers to nations with black populations as rat hole nations.

Far be it from me, but i was thinking about this the other day, it’s just a little vignette, please don’t take it at anything but face value. Our neighborhood? Pretty much all black. I live here, obviously, and at the corner, next door, and across the street there are other white people, other than that…. Not so much. So just the other day, the wife and i were sitting outside. Three teen males started running down our block, different from athletes or something, they had jeans and tshirts on and were running across everyone’s abridged front lawns… Then our neighbors 2 doors down came from the main drag and the man said there’s three guys with masks on and they sure did walk past , one clearly having a hard time with the gun inside his waistband. So they passed, and all i could say was ‘that’s not cool, that guy has a firearm on him’ and so the wife and our neighbors got to talking about a couple robberies that happened, and we all watched a few more teens run or walk through our block, but the fear was palpable, it came off the other couple like a fog or mist…

The steadfast adherence to talking points, his fairly narrow character profile (he volunteers things like age, gender, career, etc… that many of us do not and then repeats them in every thread to establish his persona), viewing events through a White-centric lens and especially the linguistic patterns that sometimes feel like English is a second language. In the end, I decided that it didn’t matter. I’ve engaged with numerous White people that parrot the exact same arguments and engaging with Allen gives me additional insights to use in those face-to-face conversations. Plus, the magic algorithms of the inter-webs love all the blog activity he generates so, it’s gotta be good for Abagond right?

Any individual that is apathetic about police brutality on black bodies gets the middle finger from me. Being apathetic about systemic oppression and racism and parroting Fox News talking points tells me exactly who an individual is.

On second thought, you are right. A. Shaw is no Black sockpuppet. The clue was right there in front of me and I missed it: “They were afraid to open their wi[n]dow to talk to me!” Which proves that he is Black in appearance.
Shaw is just another “respectability politics” Negro. He is wedded to White Supremacy beliefs. I’ve met other African descent people who share similar beliefs.
Shaw’s performance on this forum reminds me of Lawrence Otis Graham. In 2014, Graham was featured in a Washington Post article, where he admitted, “I taught my black kids that their elite upbringing would protect them from discrimination. I was wrong.”
The post you wrote about Graham outlines how he and his wife operated under the assumption that anti-Black racism was due to the behaviors of Black folk. The Grahams strove to imitate upper income White behaviors. When their kids became teens they found out that White Supremacy and anti-Black racism have nothing to do with Black behavior—and everything to do with White beliefs and worldview.
The very first comment on that post’s thread was from hunglikejesus who wrote:
With Shaw, we see a grown Black man who managed to calcify in his beliefs and stay that silly for decades.
Since Shaw brings little value or knowledge to comment conversations, I will treat him as just another White Supremacist troll, à la Biff.

@Afrofem: Shaw still comes off like a troll to me. He has nothing of substance to offer in discussions. He also mentioned where he lives there are no black people in his community. Which is why he has no empathy for underserved black communities. Especially when he made the statement he had not been impacted by modern day troubles of black people today. And that is where the boot strap garbage that he likes to proselytize.

Allen Shaw is well within Black norms. I know someone like him in person – he even has a Blue Lives Matter flag.
ALL Americans of ALL races are brainwashed by White racism, it is just a matter of degree. Do not fool yourself.

I agree. His Harlem story does not sound like something a White person would make up – or experience. But it does sound like something a pro-police non-White person would experience – and not make up.
I can completely imagine Allen Shaw going to the police in Harlem – and I can completely imagine them not rolling down their window for him.

@Abagond: I was actually friends with a person like this for fifteen years. Until I could no longer stand it. I severed ties with them last November. She actually had the same mentality as Shaw. That was a very challenging friendship. It was starting to have a negative effect on me. And she even had the same attitude about Eric Garner and Mike Brown in Ferguson. Referring to those black men as thugs. And she had a very apathetic attitude about the Katrina victims. And she said she constantly complained about her black coworkers. She too had lots of internalized anti-blackness. She rejects all things related to black culture and blackness.She is a female version of Shaw.

There is plenty of white supremacist adjacent racialized people just as there are ‘white allies’. It’s feasible that Shaw is black. As with many here, I have come across such folk. There are many who are literally gobsmacked when they learn that whites disdain them. The crude term is NWC.

If you only rely on mainstream news outlets and department of Justice statistics or findings to tell the entire social story of America you are literally fueling unnecessary anger. Thinking this stuff only happens to black people or border immigrants… Yes there’s an agenda of emphasizing black people and run ins with the law but there is an ongoing untold elements in the background as well. And until those issues are solved…
