Oscar Grant III (1986-2009) was killed in the early hours of January 1st 2009 by the police of the Bay Area Rapid Transit (BART, the trains of the San Francisco bay). He was shot in the back by police officer Johannes Mehserle. When Grant was shot he was face down on the ground, unarmed and, just before he was shot, had a knee in his back. You can see it (kind of) on YouTube.
Why was Grant shot?
Some say it was all a mistake, that Mehserle thought he was pulling out his Taser to stun Grant but pulled out his gun by mistake.
Others say it was because Grant was black and a black man, even face down on the ground with a knee in his back, is still somehow a deadly threat. Grant is just the latest in a long line of unarmed black men killed by the police. Sean Bell was the latest well-known one in New York. There are too few white ones to think that race has nothing to do with it, to think that they are all “mistakes”.
Some in the press have been quick to point out that Grant has a police record and has been to prison. As if that somehow makes a difference in this case.
Mehserle has not been charged with any crime. He has left the police force and does not speak to the press. Grant’s family is taking him to court for $25 million in damages in a wrongful death lawsuit.
The video that we have comes from the mobile phones of the passengers on the stopped train. Right after the shooting, the train doors were closed and the police took many of the phones, but they did not get them all. There is also video from the BART cameras in the station. That video has not been made public.
There have been protests in Oakland. One march on city hall turned violent, burning cars and breaking shop windows.
Oakland is across the bay from San Francisco. It is a mixed race city of 400,000. For cities of its size it has one of the highest murder rates in the country. Black men in Oakland are being killed and thrown in prison in high numbers. Bill Cosby says it is due to a lack of a moral upbringing on the part of blacks.
John McWhorter would call the shooting, at worst, an “imperfection” of post-racial America.
Grant and his friends were coming home from a night in San Francisco to bring in the new year. A fight broke out on the train. When it arrived in the Fruitvale station, the police stopped the train and pulled off Grant and some of his friends. They did everything the police told them to do.
Grant, 22, worked in the meat department at Farmer Joe’s Marketplace. He lived with his girlfriend and their four-year-old daughter. He has served time in prison for selling drugs but seemed to have been setting his life straight.

The use of deadly force by the police in this instance was without question unwarranted. Mehserle ought to be criminally prosecuted. It’s one of the most awful incidents of police shooting to receive national publicity since Amadou Diallo.
My understanding is that Grant was struggling against the officers. This doesn’t justify the shooting. However, if it were true it would mean that Mehserle would have committed some form of negligent homicide or manslaughter as opposed to outright murder.
By the way, is that true about the police taking cell phones of BART passengers? I’d not seen that. I believe that would be a violation of several Constitutional rights of the passengers.
As to Oakland’s high homicide rate, I reckon many will figure out a way to ascribe it to racism despite the fact that in a large percentage of instances it is black people killing other black people (very often involving gang issues). You also often see crimes involving black people killing whites or asians during the commission of crimes.
I lived in Oakland for about 10 years and saw much of this violence first hand. There is a thug mentality throughout much of Oakland. It’s pretty deeply infused into the town’s culture, to the point where even Oakland’s home-spun little Black Muslim offshoot, with its tasty pies and cakes — founded by the former Yusuf Bey, a ludicrous individual who, as it turns out, in addition to being an unwitting source of stoner humor for viewers of late night public access cable (along with the likes of Dr. Gene Scott), was a child rapist and thug — is little more than a front for an extortion racket directed mainly against Oakland’s black business people.

They need to be more respectful as well. He was a good young man who was struggling to raise his child and go to school at the same time.

This was of course unjustified. You can tell the cop told the other cops to clear the suspect. everyone took their hands off of him Which is done before a person is tazered. He ment to pull his tazer and screwed up BIG TIME. You can see the look of shock on the cops face..of unbelief. He screwed up (horribly wrong). Perhaps you could argue the fact that Oscar was arrested was a race issue. You can discuss the number of black males vs. white males arrested or any number of other problems we have with our justice system. even the fact that the officer choose to taz oscar ws racially motivated perhaps.
But – If you watch the video you clearly see the other officers clear their hands like they are trained (similar to in a hospital before you shock someone to restart their heart)and you see the look of shock on the officers face when a gun goes bang instead of zap. Its obvious that the SHOOTING part of this was not racially motivated – it was a HUGE F-Up. clearly involuntary manslaughter – not murder with intent.
If we call everything a race problem…then it loses its meaning. The arrest could be argued as a symptom of the continuing problem black americans experience…The shooting in this one instance was obviously a f-up.

Abagond _ I was actually waiting for you post on this. Living in san francisco – I have been following the story since it occured. Its one of those things that just saddens me so deeply when you hear about it.
I had the same emotional reaction when Russia rolled into georgia…its a “No No No – we are supposed to be moving away from this sort of thing” feeling…sadness for Oscar and his family, sadness for the child born the next day to the cop, sadness for the community.
At the same time worry – my sister is a cop in SF, she is working these protests…my fear and worry for her and her husband as they do their job. Also fear my sister and her husband will be painted with the same brush as the bart cop who is such a failure. My sister had to shot a women in august…5150 women who was trying to stab her with a knife and didnt react to pepper spray (a white women I might point out). Its so easy to paint these things with bold strokes…as similar…when the job of a police officer is such a hard job… and people remember these instances and not all the good things a cop does. And one bad apple really does spoil the whole bunches perception.

I saw the video and from the movements of the cops, it looks as if the cop REALIZES he screwed up.
The real question is why do some cops in general seem to lean on the aggressive side in regards to black people under arrest?
Why was the cop looking for his “taser” in the first place, Oscar was under arrest, he wasn’t going anywhere. For the cop to try and tase Oscar would have been extra cruelty.

sparkle – that is an excellent question…Even coming from a family of law enforcement I feel that people go for the taser to often and dont use verbal judo.
There was once a study done where half the students were called “overseers” the other half has “prisoners” and it was racially diverse and gender diverse groups…after a week I believe – the overseers started acting aggresively and in a manner they never had before. its the old…power corrupts issue.

Imagine every day, every interaction is with people having the worse day of your life. every day your dealing with the negative things. every day you see husbands and wifes fighting, children abused, child who are not being brought up right, people at their worst. Its hard to take a step out of it at the end of the day and remember that everyone is not like this. To see the goodness in people..remember even your basic american who has been pulled over for a minor infraction compulsively lie to a cop. Hell – when I get pulled over I have lied to cops…everyone does. About why you were speeding, why you dont have a license plate on, why you didnt see that stop sign. My husband was a cop…and he started treating me like i was lying to him with everything I said. It burns you out.
this is NOT in defense of the cop who shot oscar, that cop doesnt have a defense…he screwed up.
but it is an insight into what your basic good cop deals with every day and why they may seem to be an ass when they pull you over. its a very hard job.

The arrest could be a race issue, the tasing could be a race issue, the only thing I think is NOT a race issue is the shooting – it was an horrible accident.
About people being murdered with small children I would say it is sad. Oscars child has lost her father. And theore this act of violence will reach out into her young life and affect her forever.

i think it’s sad that it’s already 2009 and this had to happen. now i can’t sit up here and think it’s a race issue because he did look shocked if you pay attention to the video. but he should’ve look to see if he had a taser before pulling something out and thought it was a taser and it wasn’t. everytime a police men shoot a black person it’s always a mistake, for some reason. i think he did make a mistake but he should serve time for what he did, mistake or not, because he took a person’s life that can’t be brought back. i’m from oakland and to see the whole thing on t.v. is sad and disturbing to watch. then to see the riots that happen in downtown was something i didn’t see coming but it could’ve happen sooner or later. but in my honest opinion, even though he was wrong, i don’t think he’s going to jail for it because something like this happen, sean bell and rodney king for example, they usually turn out not guilty and the people are mad. so i think there will probably be another riot happening in oakland. so you just never know.

It’s not always conscious racism, but an unconscious belief in racial inferiority, a belief that some lives are disposable, that leads to this over the top response to non-whites by law enforcement. In this situation–man on his belly, knee in his back–if he’s white does the cop go for his ‘taser’? No, he wouldn’t. That white person’s life has worth & the cop would restrain himself from taking it further.
This officer should be behind bars–it’s still murder–accidental or not.

From living in New York, my view of the police is not as benign as yours. It was quite clear to me that they were there to protect the rich against the poor and whites against blacks. Many are arrogant, corrupt and get away with murder. As a whole they hold black life very cheaply.

Just wondering if these situations are not racially motivated, why do black men always seem to die when officers are around? Okay white folks got that kid that was tasered but our (often times unarmed) men get killed. He had a family who will be missing him. But race has nothing to do with it. Bart cops are more like rent a cops. I am guessing the cop was panicking a little and decided to pull his and say “don’t move” and the gun went off. (I don’t buy the “I was reaching for a taser” story) That’s the danger of semi-autos. Police should go back to using revolvers.

Eric Kleemeyer, a 22 year-old white man, was killed by Santa Clara Police on January 4th, 2005. He allegedly did not pull over, as he was driving to his mother’s house. He was unarmed and feared for his life, due to a previous beating that had gone unreported. The family later learned of a third car that had pinned Eric in when he was shot. His family believes that after the shooting, the cars were moved to make the scene look like Eric had rammed a police car. 1/4/05
Brian Patrick O’Neill, 33, was pepper-sprayed, shot twice with a taser, and struck on the chin with a baton by San Jose police. When police began to tie his arms and legs with nylon restraints, he collapsed and stopped breathing, 8/1/2005
Steven L. Fountain. 24 year old white man, tased and fatally shot by Campbell police. He had been yelling outside of his hotel room, saying that there was someone in his room. 9/7/2005

I want to comment on both issues here. First, cops: yes they do have a hard job, but they chose this as their job. But what does need to change is the fact that cops can be youngsters just getting out of high school. They are not people that have some years of life experiences under their belt. Dealing with “humans” not just races. I believe that cops should go to not just their POST academy (4months), but to become an officer should be made to go to at least a 2 year college curriculum. Here they should have classes in how different cultures act and deal with lives issues. Anyone dealing with the general public in this sort of job should be older and wiser than the rest of the population at large. For example nurses (RN’s), they must go to a 2 year college taking classes towards an associate degree which has them take many classes learning about life, history, cultures etc… BEFORE they take their nursing classes. This makes them more aware of “humans” as a whole and a better rounded off individual. 4 months of Police academy hardly teaches you how to deal with “humans”, it teaches you how to bring down, arrest, chase and shoot. Oakland is predominantly black…so what we know this, just like other communities may be predominantly White or Hispanic or Asian. But no matter what community you work in, you should be able to deal with and realize that not everyone acts and reacts the same. And yes these reactions do have a race component!!! Cops deal with the people that don’t follow the rules of the land, so yes they do deal with the “worst” of the population, but that does not mean that EVERYONE in that population is the same. But day after day they become calloused to the fat that there are good people, that people can and do change for good or bad. They are just expecting the worst out of every encounter…that’s the job. Someone with more education behind them, a little older, learns how to deal with stressful situations as the Oscar Grant situation. With someone already on the ground face down and a knee in their back, will assimilate that and put aside the other yells and hoots from the crowds and do their job. I think that cop got flustered, got nervous that more shit was gonna come down and reacted in a hurry to end the situation at hand. I don’t think he meant to shoot Oscar. May he RIP.
The second issue is the community as a whole. With life being as hard as it is, people take other means out. Generations later, we have hoodlums…in all RACES. But we are talking about just Oakland right now, so OF COURSE they will be black! Cops expecting the worst with every encounter already, get flustered and become more prejudiced. Everyone becomes a suspect, everyone is guilty somehow. That is in EVERY community. A black cop in a white neighborhood thinks this same way. Any race cop in any race community thinks the same way. WE are guilty somehow. The real issue to look at is why….why is Oakland one of the most dangerous places to live in the nation? Certainly not because it is crime free. We just moved to Oakland 3 months ago. We work hard for the little we have, yet we had a car stolen from in front of our house last month. It put a damper on our work life because of tools needed for the job were now gone. If life wasn’t so hard for all of us, whom ever stole the car would not of felt they could “come up” on these tools and perhaps eat for the next week, or pay rent or whatever. Disparate people do disparate things!!!
All I know is what I have read about Oscar. That he had been to prison but he had changed his life around and was working and supporting his own. THIS is the real lesson here for all of us….NOT RACE but the betterment of all of us. To rise above, to change ourselves no matter what race we are. We have choices here. We can either stay in that crime mentality: taking things from others, stealing for a living and so on or change for a better way of life. In this nation education is free for all. Steal that and run with it. For a better community for a better “self”. What a better message could be sent to the world that Oakland is NOT the most dangerous place to live but is now the BEST place to live? That would be a start to put some justification into this horrible situation.
My condolences to Oscars family and to Mehserle’s family, both are grieving in different ways.

You and people like you is why RACE will always be an issue because your “White Lens” wont allow you to get over yourself. For some reason even you think its business as usual for Black Men to be killed daily just so long as your Sister and her Husband can keep a job and a roof over their heads. And i say that becuse you kept trying to prove that it was not racially motivated even though you know these killings dont happen to the majority race in this Country. The media does not portray these Men as Valueable, Fathers or Men (They are seen as Male but not Men) That deep down fear rooted entitlement is why you were moved so passionately to speak because certainly your reasoning outweighs fact. Black People die mainly so that Whites feel safe. Your safety has come at a GREAT COST to many Tribes & Tongues on this Earth that want nothing more than to live and let live. It is amazing how you see no connection between your comfort and the pain, filth, hunger, death and aggravation that many brown people drown in daily. Next time you feel like giving us your opinion DONT! This Blog was about Oscar not YOU!!!
